Job description Position Overview The Chief Manager Legal & Resolution will be responsible for managing recovery and resolution of stressed assets acquired by the ARC, driving legal enforcement strategies, coordinating with advocates and stakeholders, and ensuring effective implementation of recovery mechanisms under applicable laws including SARFAESI, IBC, RDB Act, and other recovery frameworks. The role requires a combination of legal expertise, resolution strategy, stakeholder management, and recovery execution capabilities. Key Responsibilities 1. Legal Recovery & Enforcement Handle and supervise litigation and recovery matters before DRT, DRAT, NCLT, NCLAT, High Courts, Civil Courts, and other judicial/quasi-judicial forums. Drive enforcement actions under the SARFAESI Act including possession, auction, sale, and recovery proceedings. Coordinate with empaneled advocates, legal consultants, valuers, and enforcement agencies. Review and approve legal notices, pleadings, written statements, appeals, rejoinders, and settlement documentation. Monitor ongoing litigation and ensure timely legal actions and compliance with court directives. 2. Resolution & Recovery Management Develop and implement resolution strategies for stressed assets and NPA accounts. Drive settlements, restructuring proposals, One-Time Settlements (OTS), and enforcement actions. Engage with borrowers, guarantors, lenders, resolution applicants, and investors to maximize recoveries. Track portfolio performance and recovery milestones against approved business plans. Support preparation and execution of recovery action plans for acquired assets. 3. Insolvency & Bankruptcy Matters Manage cases under the Insolvency and Bankruptcy Code (IBC). Coordinate with Resolution Professionals (RPs), Liquidators, CoC members, and legal counsels. Review Resolution Plans, Information Memorandums, and liquidation-related documents. Represent ARC interests during CoC meetings and insolvency proceedings. 4. Due Diligence & Asset Acquisition Support Conduct legal due diligence of stressed asset portfolios proposed for acquisition. Review loan documents, security documents, title reports, and litigation status. Identify legal risks and recovery opportunities during acquisition evaluation. Provide legal inputs for bid submissions and acquisition proposals. 5. Stakeholder & Relationship Management Liaise with banks, financial institutions, borrowers, advocates, regulators, and government authorities. Attend borrower meetings, settlement discussions, and legal proceedings. Build strong relationships with external legal partners and recovery agencies. 6. Compliance & Governance Ensure compliance with RBI guidelines applicable to ARCs. Maintain proper legal documentation and case records. Monitor regulatory developments affecting ARC operations. Support internal and statutory audits relating to legal and recovery matters. 7. MIS & Reporting Prepare periodic MIS on recoveries, legal cases, settlements, auctions, and resolution status. Present portfolio updates and recovery forecasts to senior management. Track key recovery metrics and resolution timelines. Qualification LLB from a recognized university (LLM preferred). Additional qualifications in Insolvency, Banking, Finance, or Recovery Laws will be an advantage. Experience 5-10 years of experience in Legal, Recovery, Resolution, ARC, Banking, NBFC, or Financial Services sectors. Strong exposure to: SARFAESI Act Insolvency & Bankruptcy Code (IBC) RDB Act / DRT Proceedings Recovery Litigation OTS & Resolution Frameworks Enforcement and Security Realization Knowledge & Skills Strong understanding of ARC business and distressed asset resolution. Excellent drafting and legal interpretation skills. Ability to independently handle recovery and legal portfolios. Strong negotiation and settlement management capabilities. Proficiency in legal MIS and case management. Effective stakeholder management and communication skills. Key Performance Indicators (KPIs) Recovery realization against targets. Resolution turnaround time. Success rate of settlements and OTS closures. Reduction in ageing legal cases. Timely execution of SARFAESI and enforcement actions. Effectiveness of litigation management. Compliance with regulatory and internal timelines. Portfolio recovery efficiency and resolution outcomes.
